Where is the study on the “Plan d’Organisation du Travail”?

The study on the reduction of working time refers to the results of the study on the “Plan d'Organisation du Travail” - POT for short - which was introduced by law in December 2016. However, the results of the POT study have not yet been published. The DP MP Carole Hartmann has therefore asked the Minister of Labour, who commissioned this study, when the results will be presented.

« En décembre 2016, des adaptations du droit du travail ont été effectuées en ce qui concerne l’organisation du travail. Avec l’introduction du “Plan d’organisation du travail” (POT), les entreprises ont eu la possibilité de définir des périodes de référence qui devaient permettre une plus grande flexibilité dans l’organisation du travail des salariés.

La loi de 2016 dispose que 5 ans après l’entrée en vigueur de la loi, un bilan intermédiaire des nouvelles dispositions doit être effectué. Le LISER a été chargé de cette étude par le ministère du Travail. Le projet a débuté le 23 novembre 2020 et s’est terminé le 31 décembre 2022.

La nouvelle étude du LISER sur la réduction du temps de travail se réfère précisément à l’étude sur le POT, mais aucun résultat de cette dernière n’a encore été publié officiellement.

Dans ce contexte, j’aimerais poser les questions suivantes à Monsieur le Ministre du Travail, de l’Emploi et de l’Économie sociale et solidaire :

  • Monsieur le Ministre, pour quelles raisons les résultats de l’étude POT n’ont-ils pas encore été publiés, alors que le LISER lui-même fait référence aux résultats de cette étude ? Quand peut-on s’attendre à une publication des résultats de l’étude POT ? »

More legal certainty before the labour court?

This leads to problems in the enforcement of labour law and to legal and financial difficulties for the employer. The DP MPs therefore wanted to know from the Minister of Labour how he interprets the relevant paragraph in the Labour Code, whether the rejection of the counterclaim by the President of the Labour Court is in accordance with the law and whether more legal certainty should be provided.
