Strengthening the rights of pregnant self-employed workers

Pregnant employees can apply for dispensation from work before their maternity leave, for example if they are unable to work for health reasons. The self-employed do not have this option, which can have a negative impact on the recalculation of their maternity benefits. DP MPs Carole Hartmann and Mandy Minella have asked the relevant ministers whether paid dispensation from work or an equivalent mechanism will be introduced for pregnant self-employed workers.

« Les salariés et les indépendants sont parfois soumis à des dispositions différentes du droit du travail.

Les salariées enceintes peuvent par exemple demander une dispense de travail sans perte de rémunération si elles ne peuvent pas exercer leur profession pour des raisons de santé ou de sécurité avant d’avoir droit au congé de maternité. Les femmes indépendantes n’ont pas cette possibilité, ce qui peut les priver de revenus pendant des mois.

Cela a également des conséquences sur l’indemnisation du congé de maternité. Pour les indépendantes, celle-ci est calculée sur la base du salaire moyen dont dispose le Centre commun de la Sécurité sociale pour les 12 mois précédant le congé de maternité. Toutefois, si une indépendante ne peut pas travailler quelques mois avant son congé de maternité, son salaire moyen sera inférieur. Lors du recalcul de l’indemnité, la travailleuse indépendante doit donc rembourser une partie de l’indemnité perçue.

Dans ce contexte, nous aimerions poser les questions suivantes à Monsieur le Ministre du Travail et à Madame la Ministre de la Santé et de la Sécurité sociale :

  • Monsieur et Madame les Ministres, pensent-ils qu’il soit possible de permettre aux femmes indépendantes de bénéficier d’une dispense de travail sans perte de rémunération ou d’un mécanisme équivalent si elles ne peuvent pas exercer leur profession pendant leur grossesse pour des raisons de santé et de sécurité ? Dans la négative, pour quelles raisons ? »

More legal certainty before the labour court?

The DP MPs therefore wanted to know from the Minister of Labour how he interprets the relevant paragraph in the Labour Code, whether the rejection of the counterclaim by the President of the Labour Court is in accordance with the law and whether more legal certainty should be provided.
