Relocation of the Vianden pharmacy to the commune of Tandel?

It seems to be the case that the pharmacy will be transferred from Vianden to the commune of Tandel. DP MP André Bauler has asked the Minister of Health whether there is a concrete wish for this transfer and whether there have already been discussions with the relevant municipal authorities.

« J’ai appris par la presse que la pharmacie de Vianden devait être transférée à Fouhren dans la commune voisine de Tandel, à proximité d’un cabinet médical qui reste à créer.

Voilà pourquoi j’aimerais poser les questions suivantes à Madame la Ministre de la Santé :

  • Existe-t-il actuellement une demande concrète de transfert de la pharmacie de Vianden vers la commune de Tandel ?
  • Le ministère de la Santé a-t-il déjà eu des entretiens ou des échanges écrits avec les autorités communales compétentes ? Dans l’affirmative, quelles conclusions en ont été tirées ?
  • Le ministère est-il prêt à transférer la concession liée à l’ouverture d’une pharmacie de la commune de Vianden à la commune de Tandel ? »

Answer

A ce jour, le ministère de la Santé n’a pas été saisi d’une demande concrète pour le transfert de la concession de Vianden.

Le ministère de la Santé a eu un échange avec le mandataire d’une autorité communale compétente.

La pharmacie de Vianden a été créée sous l’empire de l’ordonnance royale grand-ducale du 18 octobre 1841 et reste soumise au régime légal issu de ladite ordonnance.

Dans ce cadre légal, le ministère de la Santé n’est pas compétent pour autoriser ou refuser un transfert d’une pharmacie.

En effet, contrairement à la loi modifiée du 4 juillet 1973 concernant le régime de la pharmacie, applicable aux concessions de pharmacie, l’ordonnance du 18 octobre 1841 précitée ne prévoit pas de base juridique pour trancher une demande de transfert de pharmacie. Dès lors, aucune autorité administrative ne dispose de la compétence pour autoriser leur transfert dans une autre ville ou commune.

Medical referrals abroad

Since 1 June 2025, doctors have to fill out a new form if they want to send a patient abroad for treatment. The doctor must now indicate whether or not the services can be provided in Luxembourg within an ‘acceptable period’. If the doctor indicates that the services could actually be provided in Luxembourg, the referral request is automatically rejected.
DP MP Dr Gérard Schockmel has asked the Minister of Health whether the mere reduction to the ‘acceptable period’, without taking into account the quality of care, might not lead to unjustified rejections and whether the new form might not force doctors to provide false information in order to guarantee their patients the best possible care.
