Relocation of professional firefighters from the north?

Deputy André Bauler asked the Ministry of the Interior if it was right that professional firefighters from the CGDIS centers in the north of the country will be transferred to other regions of the country.

Fro

„Mir ass zougedroe ginn, datt an de CGDIS-Zentren zu Clierf, Nordstad a Wooltz Beruffspompjeeë sollen ofgezu ginn, fir an anere Regiounen agesat ze ginn.

Et ass kloer, datt dës Decisioun, sollt se dann ëmgesat ginn, d’Disponibilitéit u Personal an eisen Ambulanzen net verbessert.

Dofir wollt ech der Madamm Inneministesch folgend Froe stellen:

  1. Stëmmt et, datt Personal aus dem Norden ofgezu gëtt an an aner Zentre reaffektéiert gëtt ?
  2. Wa jo, wat ass d’Ursaach dofir ?
  3. Wou sollen dës Persounen nei affektéiert ginn ?
  4. Wéi gesäit de Moment de Personaltableau an de CGDIS-Zentren Norden aus a wat gëtt konkret ënnerholl fir si bei wuessender Bevëlkerung personell ze verstäerken ? “

Answer

More legal certainty before the labour court?

If a staff representative has been suspended due to serious misconduct, an employer can request that the employment relationship be terminated in court, e.g. via a counterclaim. However, DP MPs Corinne Cahen and Carole Hartmann were informed that the President of the Labour Court repeatedly rejects these applications. This leads to problems in the enforcement of labour law and to legal and financial difficulties for the employer. The DP MPs therefore wanted to know from the Minister of Labour how he interprets the relevant paragraph in the Labour Code, whether the rejection of the counterclaim by the President of the Labour Court is in accordance with the law and whether more legal certainty should be provided.
