Registration costs in the case of a separation

If one partner buys the other’s 50% share of the jointly acquired property, they must pay registration costs again on that share. Our MP Corinne Cahen has inquired whether there are plans to reduce this financial burden.

„Wann eng Koppel zesummen ee Logement keeft, ënnerläit dës Transaktioun normalerweis Enregistrementskäschten vun 7%, aktuell reduzéiert op 3,5% bis Enn Juni 2025. Am Fall vun enger Trennung, wou ee Partner dem aneren seng 50% vum Logement ofkeeft, muss den Acquéreur erëm Enregistrement op dës Quote-Part bezuelen.

An deem Kader wollt ech dem Här Finanzminister follgend Fro stellen:

  • Ass de Minister gewëllt an dësem Fall eng Ausnam oder eng Erliichterung virzegesinn, fir d’finanziell Belaaschtung vun de betraffene Persounen ze reduzéieren, déi sech dacks schonn an enger schwéierer finanzieller Situatioun befannen?“

Answer

Et sief virweg drun erënnert, dass de sougenannten „Bëllegen Akt“ fir Haaptwunnzwecker zanter dem 1. Januar 2024 an nach bis den 30. Juni 2025 vun 30.000 Euro op 40.000 Euro pro Persoun an d’Luucht gesat ginn ass.

More legal certainty before the labour court?

If a staff representative has been suspended due to serious misconduct, an employer can request that the employment relationship be terminated in court, e.g. via a counterclaim. However, DP MPs Corinne Cahen and Carole Hartmann were informed that the President of the Labour Court repeatedly rejects these applications. This leads to problems in the enforcement of labour law and to legal and financial difficulties for the employer. The DP MPs therefore wanted to know from the Minister of Labour how he interprets the relevant paragraph in the Labour Code, whether the rejection of the counterclaim by the President of the Labour Court is in accordance with the law and whether more legal certainty should be provided.
